Sentencia de 3 de marzo de 2020."},"content":{"rendered":"<h3><span style=\"color: #000000; font-family: Arial, Helvetica, sans-serif;\">Seg\u00fan la Sentencia la cl\u00e1usula que regula el inter\u00e9s del pr\u00e9stamo hipotecario en base al \u00edndice de referencia de las cajas de ahorro (IRPH), est\u00e1 comprendido en el \u00e1mbito de la Directiva europea sobre cl\u00e1usulas abusivas.<\/span><\/h3>\n<hr \/>\n<p><strong><span style=\"color: #000000; font-family: Arial, Helvetica, sans-serif;\">\u00bfPor qu\u00e9?<\/span><\/strong><\/p>\n<p><span style=\"color: #000000; font-family: Arial, Helvetica, sans-serif;\">Porque esta cl\u00e1usula no refleja disposiciones legales o reglamentarias de car\u00e1cter imperativo.<\/span><\/p>\n<p><strong><span style=\"color: #000000; font-family: Arial, Helvetica, sans-serif;\">En caso de dictaminarse que la cl\u00e1usula es abusiva, podr\u00e1 substituirse por un \u00edndice supletorio.<\/span><\/strong><\/p>\n<p><span style=\"color: #000000; font-family: Arial, Helvetica, sans-serif;\">Los Tribunales espa\u00f1oles deber\u00e1n comprobar que las cl\u00e1usulas de esas caracter\u00edsticas sean de car\u00e1cter claro y comprensible.
